Notice of Amendment(s) to the Australia PayPal Agreement(s)

This page details and/or previews updates to PayPal users of changes to the Australian PayPal User Agreement or other online agreements, policies, or statements that require notice. You can also review Past Policy Updates notices. Note that additional changes could be made to previewed agreements on or before the effective dates listed, provided the applicable notice requirements are met.

Upcoming Changes

We’re making changes to certain agreements (listed below) that govern your relationship with PayPal. These changes will take place automatically on the corresponding effective date(s) shown below.

Actions Needed

Please carefully review the notices below and familiarize yourself with the upcoming changes. By continuing to use our services after the changes take effect, you agree to be bound by those changes. Otherwise, no further action is needed from you to accept such changes. However, if you would prefer to decline them, then you will need to close your PayPal account prior to the applicable effective date, as described in the user agreement.

Amendments to the Combined Financial Services Guide and Product Disclosure Statement (CFSGPDS)

Effective 27 May 2025:

We are updating certain fees for receiving Commercial Transactions under clause 18.4 of the CFSGPDS as follows:

If you have a negotiated merchant agreement with PayPal (“Merchant Agreement”) that amends the pricing for any of the above transaction Types (each transaction Type with such amended pricing under Merchant Agreement, “Relevant Transaction Type”), then the above New Pricing for any Relevant Transaction Type will not be applicable to your PayPal account and any pricing will be applied and dealt with in accordance with your Merchant Agreement.

Notice of Amendment(s) to the PayPal Pay in 4 Facility Agreement

Effective 21 May 2025:

  • We are amending the maximum amount of credit that may be provided under the Agreement from AU$2,000 to $1999.99 (Credit Limit) and the Pay in 4 Facility can be used for Eligible Purchases of at least AU$1 (no longer AU$30).
  • We are revising the definitions of some of the terms we use in the Agreement, including to reference the Financial Table at the start of the document. The Available Credit definition is changing to mean the amount of credit available to you under the Pay in 4 Facility. This amount will reflect your Credit Limit less the Outstanding Balance and any Transaction Amount that has not yet been processed to your Pay in 4 Facility.
  • We are clarifying that the date the Pay in 4 Facility is entered into is on the day you first agree to the terms of the Agreement.
  • We are clarifying that we may not accept the use of Pay in 4 for certain purchases in order for us to manage material risk, which includes material credit risk.
  • We are amending the terms to require you to immediately pay us any amount owing under the Agreement that exceeds the Credit Limit, in the event that this occurs, which may require payment outside the Repayment Plan under the Agreement.
  • We are clarifying that the Agreement constitutes an offer to you that you can accept by checking the tick box during the online PayPal Pay in 4 application process.
  • We are noting that PayPal has made an election under subsection 133BXA(1) of the National Consumer Credit Protection Act 2009 (Cth) that covers this Agreement, under which PayPal has agreed that Part 3-2BA of that legislation (relating to modified responsible lending obligations applies to it in relation to low cost credit contracts).
  • We are amending the notice that we must provide to you for any change to any fees or charges payable under the Agreement to be 45 days (instead of 20 days) unless the change is a reduction in the amount or time to pay the fee or charge.
  • We are clarifying that we may also commence enforcement proceedings where you are in default under the Agreement and we have provided you with notice and at least 30 days to fix the default.
  • We are clarifying the way that we will provide you with statements of account – we will notify you by email every 3 months that an electronic statement of account showing your Pay in 4 Facility activity in real time, including details of historical Repayment Plans, is available.
